Terms of Service

1. Acceptance of Terms

By accessing or using Fan Card Builder ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By creating an account, you confirm that you meet this age requirement.

3. Description of Service

Fan Card Builder is a web application that allows users to write fan messages, translate them into Korean, practice Korean handwriting, and create fan cards. The Service offers a free tier and an optional paid subscription (Premium).

The Service may also ask you to provide optional star-rating feedback about translation quality, handwriting practice, and fan card design after saving a fan card. Providing this feedback is optional and is used to improve the Service.

Free Tier: You may use the Service for free — with or without an account — with a daily translation limit of 2 translations per day. Guest users (no account) are identified by a locally stored session identifier; learning progress is not saved. Users with an account enjoy the same translation limit, plus saved learning progress and message history. Premium Tier ($2.99/month): Increases the daily translation limit to 30 translations per day and removes advertisements.

The Service uses AI (OpenAI) to generate Korean translations. AI-generated translations may not always be accurate, and we do not guarantee their correctness.

Advertising: The free tier may display advertisements provided by Google AdSense if advertising is enabled on the Service. If enabled, these ads may use cookies and similar technologies to serve and measure advertisements. Premium subscribers are not shown advertisements.

4. Subscription and Payments

The Service can be used for free with a daily translation limit and advertisements. An optional Premium subscription ($2.99/month) removes advertisements and increases your daily translation limit. Subscriptions automatically renew each month unless cancelled. You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period.

Payment Processing: On the web, payments are processed by Polar as Merchant of Record. Polar handles billing, invoicing, sales tax, and payment disputes on our behalf. On the Android app, payments are processed through Google Play Billing. PittsEdu is the service provider responsible for delivering the Service.

Refund Policy and Withdrawal Rights:

• General: No refunds are provided for partial billing periods or unused features, except as required by applicable law.
• South Korea: In accordance with the Act on the Consumer Protection in Electronic Commerce, users may withdraw their subscription within 7 days of purchase, provided that the digital content has not been accessed or used.
• European Union: Users in the EU have a right to withdraw from the contract within 14 days of purchase. However, by beginning to use the Service or accessing digital content, you acknowledge that you lose this right of withdrawal.

5. User Accounts

You may use the Service as a guest without creating an account, subject to the free-tier limitations described above. Creating an account unlocks additional features such as saved learning progress and message history. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

6. Third-Party Services

The Service relies on the following third-party providers to operate:

• OpenAI — processes your messages to generate Korean translations
• Polar — handles payment processing and subscription management
• Supabase — stores your account data, learning progress, support requests, and optional in-product feedback
• Upstash Redis — tracks daily translation usage and provides rate limiting
• Cloudflare — hosts and delivers the Service via its global CDN
• Google AdSense — may display advertisements to free-tier users if advertising is enabled
• Google Analytics — website analytics (only with your consent)
• Firebase Cloud Messaging — delivers push notifications to mobile app users
• Sentry — automated error tracking for service stability
• Discord — receives internal operational alerts

Your use of the Service is also subject to each provider's own terms and policies.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Upload malicious content or spam

8. User Content

You retain ownership of any messages or content you create. By using the Service, you grant us a limited license to store and process your content solely to provide the Service.

9. Copyright

If you believe that any content on the Service infringes your copyright, please submit a notification to kpopfancard@gmail.com with the following:

• Identification of the copyrighted work claimed to have been infringed
• Identification of the infringing material
• Your contact information
• A statement that you have a good faith belief that use of the material is not authorized

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. We do not guarantee the accuracy of AI-generated translations or the uninterrupted availability of the Service.

11. Limitation of Liability

To the fullest extent permitted by law, PittsEdu shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim.

12. Termination and Account Deletion

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause. You may delete your account at any time from your profile settings. Upon deletion, all your personal data in our active systems will be permanently removed. Residual copies in encrypted backups are purged within 90 days. Payment and billing records are maintained by Polar (our Merchant of Record) in accordance with their own data retention policies.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea. Nothing in these Terms shall limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.

EU Users: You may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through a notice within the Service at least 7 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. General Provisions

These Terms constitute the entire agreement between you and PittsEdu regarding the Service, superseding any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
